Ordered, That Mr. Clark (of ^Tusk,) do carry the said report to the senate and desire their concurrence.

Trom the county of Fairfield, Patrick Owings, who having produced his credential took his seat in the house; the oath to support the constiiuiion ofthe United States, of this state, and to discharge with fidelity the duties of a represenlativc of ihe state of Ohio, having been first administered according to law. On motion,

Mr. Morris, from the joint committtie appointed to wait on Thomas. Kirkcr, esquire, the acting governor, and to receive any communiciitions he should be pleased to make, reported, that he had received from his excellency a communication, which was presented at the clerk's table, and read as follows :
Gentleman ofthe senate, and of the houne of representatives,
I consider it my duty, under cxisruKy circumstances, only to communicate, for yom* information, the vacancies in otiice wiiich have taken place, by resignation or otherwise, since the close of the last session ; and the manner in which these vacancies have been filled ; as the governor elect, it is presumed, will commu- tate to you such other information as may be deemed neccss iry.
John Smith, senator fi'om this state, in the congress of tlic United States, halving resigned his seat, in the senate, the neces¬ sity of filling that vacancy will claim your attention at an early period of the session,
