New York (WNS)—Indicted by 20 eminent witnesses who testified to the high crimes of Adolf Hitler and his Nazi regime against Jews, minorities, labor, democracy, women, religion, world peace, civil liberties, science, arts, education, liberals free speech, press and assembly, the Chancellor of Germany and his gov- ernincnt were found guilty and branded as mankind's public enemies number one by a jury of 20,000 Americans, drawn from a possible panel of millions, who sat in solemn judgment' in Madison Square Garden at the presentation of "The. Case of Civilization Against Hit¬ lerism."
Bainbridge Colby; former secretary of State, sat as judge in the trial which was held under the auspices of the American Jewish Congress, the American Federa¬ tion of Labor, and a score of other lib¬ eral, anti-Nazi and Jewish organizations. After the witnesses, representing every field of human endeavor, all creeds, and public opinion in general, had presented a damning point by point indictment of Hitlerism, Samuel Seabury, noted at¬ torney, summed up the charges as coun¬ sel for civilization, and the Rev. Dr. John Haynes Holmes placed the charges before the jury. Without leaving the jury box, the jurors returned a verdict of "guilty as charged." No one ap¬ peared fdr the accused, although Am¬ bassador Luther was invited to testify. One woman in the balcony made a lone protest by voting "no" during the polling of the jury while all the -witnesses re¬ ceived a telegram of protest from an or¬ ganization calling itself the Ainerican Citizens League of Ohio.

tive blessings and achievements of mod- erii civilization. It has shown itself hy doctrine and practice to be the avowed enemy of those methods of peace and , freedom by which the march of civiliza¬ tion has been enabled and the progress of mankind accomplished. We declare that tlic Hitler government is compelling the Gernian people to turn back from civilization to all antittuated and barbar¬ ous despotism which menaces the prog¬ ress of mankind toward peace and free¬ dom and is a present threat against civ¬ ilized life throughout the world . ... . The German government stands con¬ victed by its own acts of a crime against civilization." . '
In summarizing the evidence, Judge Seabury declared that the force of pub¬ lic opinion will holl Hitlcrism's effprt to establish its supremacy throughout the world. Pointing out that this fprhc is greater than Hitler, Judge Seabury said "public opinion must be aroused. Jt must be organized. The emergency is great; the need for' immediate action vital. It must be crystallized at once ai^d it must find expression in a boycott against Hitlerism—a boycott as wide'as civilization and as irawerful and as strong as humanity . . . Public opinion as the force, and boycott as the weapon, will break the power ot Hitlerism,"'
Senator iMillard S. Tydings, author of the Tydings resolution liow^ pending ,111 the Senate, took isfsue with those who urged .Americans to remain silent in face of what is haijpening in Germany. He said "this is the case where, were civili¬ zation to close its eyes, and stop its ears, and stay its tongue it would be dainned forever. This is the, case where every government, claiming for itself the slight¬ est vestige of_ tolerance, the' smallest semblance of justice, and the barest out- lincof democracy should, by every hon¬ orable, peaceful and proper means,, exert its influence to the end that religious and racial persecution shall be no more among us." Expressing the hope that his Reso¬ lution would be adopted, Senator Tyd¬ ings affirmed his intention of continu¬ ing "to keep this crime pilloried before all the world, in the fervent hope that, in the councils of the present German government, a calmer view and a more* civilized, action may evolve."
Siieaking as an American who. cher¬ ishes the "liberal principles that hold us together as a nation", Professor Ray- .' mond Moley asserted that "I hate Hitler and Hitlerism not only because they have denied justice to fellow human beings. I. hate this thing because it is the enemy of my country, of my faith and of my right to be free. I believe that an Amer-^ ican cannot excuse it without impugning his own principles. He has the right to expect his government to "share in his- abhorrence and to lend what legal aid it can to. those who have suffered from Hit- " Icrism. This threat is not one to religion alone nor is it merely a battle in tiehalf of Jews. It is a fight for the integrity of American principle."
