SOlli, 1838. IN THE SENATE. After somo unimportant morning business, Ihe Senate took up for consideration the resolution yesterday offered by Mr. Rives, ofVa., calling on tho President for information relative to transactions between the GOVERNMENT AND HANK OF THE UNITED STATES. Mr Rives rose and spoke with great animation and eloquence on the subject of the following resolution, yesterday introduced by hitn. He enchained Ihe attention of the Senato and a largo auditory. His speech produced great effect. Jt' tolved, That the Secretary of the Treasury communicate to the Senate, at as early a day as practicable, the information called for undor the following heads of inquiry: 1. Thn period at which the third bond of the Bank of iho United States, sold to that institution, amounting to 2,351,871 38, was placed to the credit of the Treasurer on the books uf the bank; the terms on which it was negotiated, the person acting on behalf of the bank, wilh whom the negotiation was made, the particulars of any understanding or agreement that the proceeds of the same should be left on deposite with tho said bank until wanted in the ordinary disbursements of the Government; and what understanding or arrangement, if any, has taken place respecting the benefit which might accrue to distant places on account of the Government. fi. The period when the stun of 1,000,000, in part payment of the second bond of the Bank of the United States, was placed to the credit of the Treasurer by that bank; and the nature of Ihe agreement or under standing had in reference to the payment of a part of aid bond before, and anothor part atlcr it became due. 3. Whether any sum or sums of Iho public money havn been deposited in the Bank of lite United Slates other than those derived from the payment or sale of Its bonus; it so, the amount and date ol each deposite, and by whom and hy whose authority and direction thev were mado. 4. A list of all the branches or agencies of the said Bank of the United States on which the Treasury De partment has drawn d raits; the amount of public nion eys directed to bo placed at each, and of the drafts severally drawn on litem, and iho rate of exchange be tween rnilaiieipiiia anil each ol the places to which urns were ordered to lie iranslerretl. 6. 1 he amount, so Inr ns it can be conveniently as certained, that there has been drawn from the Bank of Ihe United Stales, its branches or neeneies, in notes or said Bank for paying Indian annuities or oilier claims of the Intlianson the Government, or for defraying the expenses unending the removal of the Indi ans; and in eeneral tho nature of the "arrantrements," if any, "made for the mora distant public disburse ments in the notes ot the bank, toirether with nil the correspondence, airreements and instructions, iriven or filtered inlo, connected with any or all the heads of inquiry above slav'tl. Also that he communicate the nature ofthe arrange ments made with him by tttoso banks in which no cording to his report of the 3d instant, portions of Ihe public money have been "placed to Iho credit of the Treasurer on special deposites," tho kinds of money in which the said "special deposites" were made, whether the same were entered on the bonks of tho bank, whether the identical moneys deposited have continued lobe held hy tho banks, whether the drafts of the Treasury Department that havo been drawn on those deposites hnvo been paid in the specfie moneys deposited, ami whether Ihe halinces remaining are part and parcel of the very moneys originally deposited.Ho spoke of tho rumors in circulation and the facts which went to show that the Bnnk and Government had an understanding, and wrro in alliance. Some of these fuels he particularized, a full and satisfactory explanation was expected from the President, in his message, inn it was not there found. We all looked to the annual report of iho Secretary of the Treasury to diasipato ail theso doubts: but that paper preserves a studied reserve premeditated mystery upon the subject. After all that had been said in the country upon it, after he had bcon entrusted with the sale of two Bonds, he sends us l paper in which vre can, with me utmost scrutiny, scarcely And line in reference to the transaction. . Instead uf giving us full details in regard to it, he merely says that the bonds nave been sold ho noes not say to what (lank lie says something of special uVprwilcs in Hanks, bit nothing lhat will satisfy the public curiosity which had been awakened on the subject. There was studied effort to conceal all the transactions of the government with this dreaded institution. But n gleam of light breaks through the mystery from another quarter. Mr. Middle's letter is explicit. He speaks in the bold and unequivocal language of a man who had achieved a triumph! Ho tells you there is no longer any controversy between the government and the Dank. He tells you what the Secretary conceals, that he bought the bonds and gave the government a credit for them on his books! He paid for the bontls in the trash the Penitentiary trash, as the paper of the Bank has been called over and over again. Instead of an anticipation of 3,500,000 it was an anticipation of 4 or 5 months. Another discrepancy. The Secretary of the Treasury tells you he had this money tin Special Depositc! But the President cf the Bank tells you it was an open credit. Now, sir, is an open credit on the books of Ihe Bank, the same thing with a Special Deposit! The country sir, will not be saiisncu wan tins thing as it stands. An explana- tioo is demanded by the country. litis thing must be scrutinized, and the Secretary of tho Treasury 0sht to be obliged to him for affording him this op portunity ot explanation. Was not the mode adopted of selling tho bonds, another way for making a compact and a condition wilh the Bank. Is it an armistice, or a trucol Is it nn alliance, or a Convention of Subsidies. If it is an alliance, is it one of defence or oflenco, or both t If it is a (.onveniion of Subsidies, which party is to pay them! These are questions which affect the diunitv of Ihe government and the interests of the people. He referred to the tone of influential journals, in tlu con fidence or the Hank, to show that an allianco with the Bank would be soon offered. One paper says, "we may see a National Bank established, by this insen-sihlo process, without the assent of Congress." The Baltimore Chronicle, an influential journal, in the confidence of the Bank, uses Ihe following language: " 1 he determination ot the Dank to pursue, liereal-ter, its own course of money making, without reference to the emergencies of the country, will be considered, we presume, as confirmatory of the suspicions that have been for some time abroad that the government and Bank will no longer be nt war. This position, however, results from the change in the nature of the Institution, and is what was to have been expected. The Bank, wilh the facilities it may render to the government, may well aspire to the post of the chief of the Deposilo Banks and will, no doubt, in the course of a very short lime, by an insensible process, become the fiscal ngent of the government. The result of all the experiments of the reign of Jackson and Van Buren will thus be to substitute a State Institution, owing no allegiance to tho General Government, for the Bank which, whilst it was tho creature of the General Government, was subject to its control and supervisory power. The money of the government will now be in vaults into which the government will have no right to look in the custody of officers whose conduct the government will have no right to scrutinize. Instead of being represented nt the Board of the Bank by Directors of its own appointment, it must now submit to entrust its millions to the control of a Board which will not allow it to say a woid as to the disposition it shall mako of its vast means. So ends the experiment." An institution irresponsible to Congress, above our reach us a State Institution, its vaults and books shut up from all scrutiny except of the two high contracting parties, will thus he created; an institution which, from the nature of its contract, must be a political agent, w'M lbn he established. Such is tho alliance attempted to be made. In the name of my country, I come forward and forbid the bans! 1 have, besides tho information sought from the Secretary of the Navy in relation to the U. S. Bank, another object. I wish to show, as I can, that banks have been employed by tho 1 reasury, in a manner which was unauthorized by law, and which is exposed to serious objections. 1 lie Secretary p-ivcs ut a list of sixteen Banks, which would not be employed under the deposite law, but which are employed as special depositories. It would be found that theso were not special depositories, any more than any other which were ever employed under the deposite act. Mr. R. also stated that the amount left in the hands of State banks, not withstanding all the homilies preached Hrrainst (lie system, is loo large for safely. I will tell yon what this means. They want a connection wilh banks, but they wish to have them as Executive agents and crea tures. I hey want Bunks if they can have the entire control of them. They are to employ them whenever they please, and dismiss litem when they please. The money power is thus to be brought under the direc tion and control or tho Executive. 1 herclore, it asks liberty to employ Banks or not, as it may suit their interest. While ihey tell us that they wish not to establish a system of Banks, regulated and sanctioned by law, they must have ono of their own, under their own direction. What is the use of the four Receivers General and your multitude of .Sub-Treasurers! They are to be kept for show, or for the purpose of extend ing f.xcculive patronage, lloih the 1'restdcnt and Secretary recognize the utility and necessity of employing Banks as fiscal agents, but thev waul the ex clusive control of them. The Secretary ncknowledies that Banks are very safe, as to tho chance of "eventual payment." A sweeping and all powerful control over the mouied institutions of the country is thus to be established, by this Executive system. Mr. Hives dwelt upon many other topics and Willi great force, in connection wilh this subject. Mr. W'rii;ht made a brief renly and Mr. Hives re joined wilh great power. Washington, Dec. SI, 1838. UNITED STATUS FF.NATK. Mr. Crittenden, of Kentucky, reported a bill to prevent ihe interference of Ki ili r il officers in tho elections of Ihe People. The hill was rend twice, and referred lo the Committee on Iho Judiciary. The bill names all Government and Slate officers, and provides thnl any attempt lo influence nn election shall be considered a high misdemeanor, 1IOUSK OF lU'.ritKSI'.NTATIVES. Mr. dishing, of Massachusetts, moved to amend the Journal of yestcrdny's proceedings by the insertion of a protest against the fifih resolution adopted by the House on ihe 12th instant, which protest staled that he allowed the petition presented hy him lo he hud upon Ihe table only through iho power ofthe House, denying at the same lime the constitutionality of ilia act. Mr. dishing wished this protest inserted yesterday, hut Ihe Speaker decided that it was not in order. Mr. Cushing renewed his motion this morning, which was nesnlived by 1 vole of 1 It 1 to 14. Mr. Wise mndn an unsuccessful effort to bring up the unfinished business being the resolution asking for a select committee tn investigate into the causes, &c. of the Now York defalcations. The Committee on Elections mado a report declaring that Judge Doty is entitled to i seat in the House at the present session of Congress, and that Mr. Jones, the sitting member, is not. The report was read, arguing the points involved in the claim at some Irnrjtli, and being rend it was laid upon the tablo and ordered to he printed. The House then look up the unfinished business the Defalcation Resolution. Mr. J times (iarland, of Virginia, proposed an amendment in the form of a resolution, asking lhat the com-milteo selected for the examination into Mr. Swart-wont's affairs be chosen by ballot. Mr. Wisp took the floor in continuation nnd conclusion of his speech begun yeslenlny. Mr. Wise made one of his most exciting and severest speeches, decla- ring among other things, that it was his most solemn belief that tho Secretary of the Treasury deserved impeachment, and would be impeached if justice was done him, or if men enough could be found willing to oe tne executioners ot justice. SOlli, 1838. IN THE SENATE. After somo unimportant morning business, Ihe Senate took up for consideration the resolution yesterday offered by Mr. Rives, ofVa., calling on tho President for information relative to transactions between the GOVERNMENT AND HANK OF THE UNITED STATES. Mr Rives rose and spoke with great animation and eloquence on the subject of the following resolution, yesterday introduced by hitn. He enchained Ihe attention of the Senato and a largo auditory. His speech produced great effect. Jt' tolved, That the Secretary of the Treasury communicate to the Senate, at as early a day as practicable, the information called for undor the following heads of inquiry: 1. Thn period at which the third bond of the Bank of iho United States, sold to that institution, amounting to 2,351,871 38, was placed to the credit of the Treasurer on the books uf the bank; the terms on which it was negotiated, the person acting on behalf of the bank, wilh whom the negotiation was made, the particulars of any understanding or agreement that the proceeds of the same should be left on deposite with tho said bank until wanted in the ordinary disbursements of the Government; and what understanding or arrangement, if any, has taken place respecting the benefit which might accrue to distant places on account of the Government. fi. The period when the stun of 1,000,000, in part payment of the second bond of the Bank of the United States, was placed to the credit of the Treasurer by that bank; and the nature of Ihe agreement or under standing had in reference to the payment of a part of aid bond before, and anothor part atlcr it became due. 3. Whether any sum or sums of Iho public money havn been deposited in the Bank of lite United Slates other than those derived from the payment or sale of Its bonus; it so, the amount and date ol each deposite, and by whom and hy whose authority and direction thev were mado. 4. A list of all the branches or agencies of the said Bank of the United States on which the Treasury De partment has drawn d raits; the amount of public nion eys directed to bo placed at each, and of the drafts severally drawn on litem, and iho rate of exchange be tween rnilaiieipiiia anil each ol the places to which urns were ordered to lie iranslerretl. 6. 1 he amount, so Inr ns it can be conveniently as certained, that there has been drawn from the Bank of Ihe United Stales, its branches or neeneies, in notes or said Bank for paying Indian annuities or oilier claims of the Intlianson the Government, or for defraying the expenses unending the removal of the Indi ans; and in eeneral tho nature of the "arrantrements," if any, "made for the mora distant public disburse ments in the notes ot the bank, toirether with nil the correspondence, airreements and instructions, iriven or filtered inlo, connected with any or all the heads of inquiry above slav'tl. Also that he communicate the nature ofthe arrange ments made with him by tttoso banks in which no cording to his report of the 3d instant, portions of Ihe public money have been "placed to Iho credit of the Treasurer on special deposites," tho kinds of money in which the said "special deposites" were made, whether the same were entered on the bonks of tho bank, whether the identical moneys deposited have continued lobe held hy tho banks, whether the drafts of the Treasury Department that havo been drawn on those deposites hnvo been paid in the specfie moneys deposited, ami whether Ihe halinces remaining are part and parcel of the very moneys originally deposited.Ho spoke of tho rumors in circulation and the facts which went to show that the Bnnk and Government had an understanding, and wrro in alliance. Some of these fuels he particularized, a full and satisfactory explanation was expected from the President, in his message, inn it was not there found. We all looked to the annual report of iho Secretary of the Treasury to diasipato ail theso doubts: but that paper preserves a studied reserve premeditated mystery upon the subject. After all that had been said in the country upon it, after he had bcon entrusted with the sale of two Bonds, he sends us l paper in which vre can, with me utmost scrutiny, scarcely And line in reference to the transaction. . Instead uf giving us full details in regard to it, he merely says that the bonds nave been sold ho noes not say to what (lank lie says something of special uVprwilcs in Hanks, bit nothing lhat will satisfy the public curiosity which had been awakened on the subject. There was studied effort to conceal all the transactions of the government with this dreaded institution. But n gleam of light breaks through the mystery from another quarter. Mr. Middle's letter is explicit. He speaks in the bold and unequivocal language of a man who had achieved a triumph! Ho tells you there is no longer any controversy between the government and the Dank. He tells you what the Secretary conceals, that he bought the bonds and gave the government a credit for them on his books! He paid for the bontls in the trash the Penitentiary trash, as the paper of the Bank has been called over and over again. Instead of an anticipation of 3,500,000 it was an anticipation of 4 or 5 months. Another discrepancy. The Secretary of the Treasury tells you he had this money tin Special Depositc! But the President cf the Bank tells you it was an open credit. Now, sir, is an open credit on the books of Ihe Bank, the same thing with a Special Deposit! The country sir, will not be saiisncu wan tins thing as it stands. An explana- tioo is demanded by the country. litis thing must be scrutinized, and the Secretary of tho Treasury 0sht to be obliged to him for affording him this op portunity ot explanation. Was not the mode adopted of selling tho bonds, another way for making a compact and a condition wilh the Bank. Is it an armistice, or a trucol Is it nn alliance, or a Convention of Subsidies. If it is an alliance, is it one of defence or oflenco, or both t If it is a (.onveniion of Subsidies, which party is to pay them! These are questions which affect the diunitv of Ihe government and the interests of the people. He referred to the tone of influential journals, in tlu con fidence or the Hank, to show that an allianco with the Bank would be soon offered. One paper says, "we may see a National Bank established, by this insen-sihlo process, without the assent of Congress." The Baltimore Chronicle, an influential journal, in the confidence of the Bank, uses Ihe following language: " 1 he determination ot the Dank to pursue, liereal-ter, its own course of money making, without reference to the emergencies of the country, will be considered, we presume, as confirmatory of the suspicions that have been for some time abroad that the government and Bank will no longer be nt war. This position, however, results from the change in the nature of the Institution, and is what was to have been expected. The Bank, wilh the facilities it may render to the government, may well aspire to the post of the chief of the Deposilo Banks and will, no doubt, in the course of a very short lime, by an insensible process, become the fiscal ngent of the government. The result of all the experiments of the reign of Jackson and Van Buren will thus be to substitute a State Institution, owing no allegiance to tho General Government, for the Bank which, whilst it was tho creature of the General Government, was subject to its control and supervisory power. The money of the government will now be in vaults into which the government will have no right to look in the custody of officers whose conduct the government will have no right to scrutinize. Instead of being represented nt the Board of the Bank by Directors of its own appointment, it must now submit to entrust its millions to the control of a Board which will not allow it to say a woid as to the disposition it shall mako of its vast means. So ends the experiment." An institution irresponsible to Congress, above our reach us a State Institution, its vaults and books shut up from all scrutiny except of the two high contracting parties, will thus he created; an institution which, from the nature of its contract, must be a political agent, w'M lbn he established. Such is tho alliance attempted to be made. In the name of my country, I come forward and forbid the bans! 1 have, besides tho information sought from the Secretary of the Navy in relation to the U. S. Bank, another object. I wish to show, as I can, that banks have been employed by tho 1 reasury, in a manner which was unauthorized by law, and which is exposed to serious objections. 1 lie Secretary p-ivcs ut a list of sixteen Banks, which would not be employed under the deposite law, but which are employed as special depositories. It would be found that theso were not special depositories, any more than any other which were ever employed under the deposite act. Mr. R. also stated that the amount left in the hands of State banks, not withstanding all the homilies preached Hrrainst (lie system, is loo large for safely. I will tell yon what this means. They want a connection wilh banks, but they wish to have them as Executive agents and crea tures. I hey want Bunks if they can have the entire control of them. They are to employ them whenever they please, and dismiss litem when they please. The money power is thus to be brought under the direc tion and control or tho Executive. 1 herclore, it asks liberty to employ Banks or not, as it may suit their interest. While ihey tell us that they wish not to establish a system of Banks, regulated and sanctioned by law, they must have ono of their own, under their own direction. What is the use of the four Receivers General and your multitude of .Sub-Treasurers! They are to be kept for show, or for the purpose of extend ing f.xcculive patronage, lloih the 1'restdcnt and Secretary recognize the utility and necessity of employing Banks as fiscal agents, but thev waul the ex clusive control of them. The Secretary ncknowledies that Banks are very safe, as to tho chance of "eventual payment." A sweeping and all powerful control over the mouied institutions of the country is thus to be established, by this Executive system. Mr. Hives dwelt upon many other topics and Willi great force, in connection wilh this subject. Mr. W'rii;ht made a brief renly and Mr. Hives re joined wilh great power. Washington, Dec. SI, 1838. UNITED STATUS FF.NATK. Mr. Crittenden, of Kentucky, reported a bill to prevent ihe interference of Ki ili r il officers in tho elections of Ihe People. The hill was rend twice, and referred lo the Committee on Iho Judiciary. The bill names all Government and Slate officers, and provides thnl any attempt lo influence nn election shall be considered a high misdemeanor, 1IOUSK OF lU'.ritKSI'.NTATIVES. Mr. dishing, of Massachusetts, moved to amend the Journal of yestcrdny's proceedings by the insertion of a protest against the fifih resolution adopted by the House on ihe 12th instant, which protest staled that he allowed the petition presented hy him lo he hud upon Ihe table only through iho power ofthe House, denying at the same lime the constitutionality of ilia act. Mr. dishing wished this protest inserted yesterday, hut Ihe Speaker decided that it was not in order. Mr. Cushing renewed his motion this morning, which was nesnlived by 1 vole of 1 It 1 to 14. Mr. Wise mndn an unsuccessful effort to bring up the unfinished business being the resolution asking for a select committee tn investigate into the causes, &c. of the Now York defalcations. The Committee on Elections mado a report declaring that Judge Doty is entitled to i seat in the House at the present session of Congress, and that Mr. Jones, the sitting member, is not. The report was read, arguing the points involved in the claim at some Irnrjtli, and being rend it was laid upon the tablo and ordered to he printed. The House then look up the unfinished business the Defalcation Resolution. Mr. J times (iarland, of Virginia, proposed an amendment in the form of a resolution, asking lhat the com-milteo selected for the examination into Mr. Swart-wont's affairs be chosen by ballot. Mr. Wisp took the floor in continuation nnd conclusion of his speech begun yeslenlny. Mr. Wise made one of his most exciting and severest speeches, decla- ring among other things, that it was his most solemn belief that tho Secretary of the Treasury deserved impeachment, and would be impeached if justice was done him, or if men enough could be found willing to oe tne executioners ot justice.
