The Circuit Court of Shelby county had Criminal jurisdiction in the 12th nnd and other civil districts of tho county. The prisonwr was indicted in this Circuit Court ntl'aleigh, and tho murder was alleged to have been committed in the IMtli district, The dividing line between the 12th and l:Uh districts, was the road leading from Memphis to Hernando. If the crime was committed in the 13th civil district the court of linleigh had no jurisdiction, ii nd tho prisoner would have to bo acquitted. The deceased was found some forty or (illy steps. from Hernando road. The witness stated that the body, as he tJionght, hnd been dragged thoro from the road; hence the doubt whether the mur der look place in the 12th or 1 :ttli civil district. At this critical point, says the report of the trial, tho counsel for the State bwthought them of certain marvelous and novel conduct of tho noble horse which hail been referred lo, which had come to their knowledge in conversation with the witness, nnd which in their iudsrmcut, settled the fpteslion of venue as authorita tively as it could have been by the tworn testimony of a score of human witnesses. Tho known instinct of animals has, from lime immemorial, been esteemed in the law as among tho sources of evidence by which the dearest rights of life, liborty nnd property, have been determined. Testimony as to these facts was proposed to be submitted on behalf of the Slate, but was stoutly opposed by the prisoner's counsel, who knew its overwhelming force. The learned judge everruled tho obiec lions and admitted tho testimony. It had been proven in the course of the trial that about 8 o'clock on tho following flunday morning that the deceased and the prisoner left Mr. Hammell's, a gentleman com ing towards Memphis met the horse proven to have been Mr. Merriweiher's, on the Hernando road, nbout two ihousnnd ynrds from the scene of the murder, and and south of tho same, galloping at full speed in the direction of Hernando, and nnd appearing lo be exceedingly frightened; with diliiculty tho gentleman inter? cepted and caught linn. There was o snddlo and bridle, and a pair of saddle bags upon nun. 1 he rein ol tho bridle was upon his neck. The gentleman find ing the annual almost uncontrollable from ngitation nnd fright, hail some diliiculty in retaining tho rein in his hand until n young man came forward nnd claimed him. The young man who claimed the horse, was recognized by tho gentleman upon the trial as tho prisoner at tho bar. He came forward, said the gentleman, claimed tho horse, thankod him gracefully for catching him, mounted and rode hur-riedlyjn the direction of Hernando. The prisoner's clothes were observed at the time to be covered with dirt as if he had been rolled upon the ground but supposing tho horse hnd thrown him, the gentleman went on his way thinking nothing of tho circumstance. Some neveral months after the prisoner had liren committed to jail under indict ment, William Merriwether, accompanied by a number of goiitlemon.witnes.ses in the case, came up from their homes in Mis-sissippi to attend thn trittl. Win. Merri- wouicr wan riding the horso of his deceased brother, which had by this time 'been recovered into the family. Their jonrnoy lay along tho Hernando road, and by the spot where the body had been found. About one or two hundred yard.i before the parly reached the scene of the murder, ihe hor.-;u upon which Mr. Win. Merriwether was mounted, began to exhibit .symptoms of alarm, and his intractable conduct much surprised his rider and the gentlemen who were with him. Thorp was no apparent cause for alarm, and tho several etlmr horses of the party betrayed none. His agitation increased as tho party approached tho fatal spot; and when they had reached a point iu the roml op polite to it, tho excitement of the horse amso to so furioous a pitch that he bo - came almost unmimiigeablo. Tho whole party checked their horses, and for a mo ment regarded tho strange conduct of the bene with profound astonishment. His flesh cpiivering his nostrils distended his eye danci'iiir into the woods where Ins noble master had mot his horrible fate he stood for a moment, snorting and neighing a sublime picture of tho wild est excitement. One of tho party sur- gesle.d to Mr. Merriwethorto give him the rein, which meanwhile had been tightly drawn. This was done, nnd instantly the nouio nnimai rusneu into the woodn, and down to the identified tree under which the body had been found, and commenced pawing nt its roots! After n moment he trotted out further into tho wood, and after making a somi-circlo in his course, re turned to tho same spot, nnd there stood neighing, trembling and pawing until he was lorced atvay. Similar exhibitions were mnde by the horso sovernl times af terwards in parsing the spot. At this startling development in the testimony, a thrill of feeling ran through the Courtroom like nn electric shock. Thus far the proof had traced Jout the history of this mysterious murder with n certainty too Jeanul to be douhtrrt nnd bad pointed to the puilid youth w ho sat in the prisoner s Jock ns the guilty ngent thereof. Justice, tempered even with an unrestrained mer cy seemed impatient for tho sacrifice, when the strong arm of tho law interposed in its might nnd majesty to shield him. The Testimony of a Horse Convicting: a Murdorer. We aro indebted to a friend for a stray copy of a southern paper, containing the following very singular story: Win. Peterson was tried al llaloigh, Shelby county, Tennessee, for the murder of Thomas !1erri wether, a younjr and in telligent planter ol MiSKissinni. 1 ha inci dents developed upon the trial were of the mopt romantic nature; and the evidence, although circumstantial, made out a clear caso ol one ol the most revolting murders to bo found in the chronicles of guilt.' I here was 0110 point in Ihe nine, about which alone thvro could b" fid to be doubt, and this point was met by l Ir evidences nllbrded liy the horse, of Mr. M. In order to understand this, we must, stale that by the law of Tennessee, tho Criminal Court of Memphis has Criminal jurisdiction of all crimes c.ouiiniltdd in the 5th, l;Uh and 1 Ith Civil Districts of said county. The Circuit Court of Shelby county had Criminal jurisdiction in the 12th nnd and other civil districts of tho county. The prisonwr was indicted in this Circuit Court ntl'aleigh, and tho murder was alleged to have been committed in the IMtli district, The dividing line between the 12th and l:Uh districts, was the road leading from Memphis to Hernando. If the crime was committed in the 13th civil district the court of linleigh had no jurisdiction, ii nd tho prisoner would have to bo acquitted. The deceased was found some forty or (illy steps. from Hernando road. The witness stated that the body, as he tJionght, hnd been dragged thoro from the road; hence the doubt whether the mur der look place in the 12th or 1 :ttli civil district. At this critical point, says the report of the trial, tho counsel for the State bwthought them of certain marvelous and novel conduct of tho noble horse which hail been referred lo, which had come to their knowledge in conversation with the witness, nnd which in their iudsrmcut, settled the fpteslion of venue as authorita tively as it could have been by the tworn testimony of a score of human witnesses. Tho known instinct of animals has, from lime immemorial, been esteemed in the law as among tho sources of evidence by which the dearest rights of life, liborty nnd property, have been determined. Testimony as to these facts was proposed to be submitted on behalf of the Slate, but was stoutly opposed by the prisoner's counsel, who knew its overwhelming force. The learned judge everruled tho obiec lions and admitted tho testimony. It had been proven in the course of the trial that about 8 o'clock on tho following flunday morning that the deceased and the prisoner left Mr. Hammell's, a gentleman com ing towards Memphis met the horse proven to have been Mr. Merriweiher's, on the Hernando road, nbout two ihousnnd ynrds from the scene of the murder, and and south of tho same, galloping at full speed in the direction of Hernando, and nnd appearing lo be exceedingly frightened; with diliiculty tho gentleman inter? cepted and caught linn. The gentleman find ing the annual almost uncontrollable from ngitation nnd fright, hail some diliiculty in retaining tho rein in his hand until n young man came forward nnd claimed him. The young man who claimed the horse, was recognized by tho gentleman upon the trial as tho prisoner at tho bar. He came forward, said the gentleman, claimed tho horse, thankod him gracefully for catching him, mounted and rode hur-riedlyjn the direction of Hernando. The prisoner's clothes were observed at the time to be covered with dirt as if he had been rolled upon the ground but supposing tho horse hnd thrown him, the gentleman went on his way thinking nothing of tho circumstance. Merriwether was mounted, began to exhibit .symptoms of alarm, and his intractable conduct much surprised his rider and the gentlemen who were with him. Tho whole party checked their horses, and for a mo ment regarded tho strange conduct of the bene with profound astonishment. The verdict of I ho jury wns, that the prisoner wns guilty of murder in tho first degree as charged in the bill of indictment, nnd the sentence of death wns pronounced against hiin, which was afterwards com muted to imprisonment for lile in the .Slate penitentiary.
