Barrows, who, haring heretofore been worn, identified a certain paper offered, as the handwriting of JoBian a. unite. The Judge Advocate accordingly moved amend the first charge on whioh the pris oner is arraigned, by substituting the name Joseph whito as one or the prisoners with whom the defendant is charged with conepiriug to oause the death of Union pris oners. Mr. Baker ohjeoted to the motion to sup ply Ihe misnomer. He argued that the pris- er was arraigned on these oharges by or- U r of the President, and tbat until the orig- al aulhorily should supply the dohoienov no l'urlher testimony oould be read aSeoting ur. While, and the prisoner at the bar. Tho Court overruled the oDjeelion, whon o namo of Dr. White was corrected. Mr. Baker said that the name of John II. inder also appeared as one of Ihe alleged conspirators. The fact was, however, notorious, that Winder is dead ; and therefore is is silling here trying a man not in ex istence, lie moved to strike out the name Winder. Tho Judge Advocate "Do you appear for inder? ' Mr. Baker "No." The Court "Do you hold that Winder is trial Mr. lltker "I hold Windor, who is dead, OAunut he triod for oonspiraoy." Ihu Judge Advocate "Wehavo not been formed that Winder is dead." Mr. Baker- "It is a notorious faot, of whioh tho world has takon oognisanoe." Mr. Baker "A military commission could manv mines not common for a civil court, but they oould not try a dead man." t he court overruled the motion to strike out the name of Juo. II. Winder. Dr. Birrows further testified that at An-rsonvillo prisoners wore arrested for buy ing green corn, which the guard took away from them. Corn is an antisoobio in oases sourvy, and is a useful diet. The slops the cook-house were thrown iu the Btream which ran through the prieon, the exhalations from ivhioh were terrible and very unhealthy: besides, the 'sink overflowed, owing to the rains, rendering the premises still moro intolerable. Human bodies some times lay unhurried for three days. The stench was terrible, sensibly affecting the atmosphere, and was worse than that from any disBeoting room. Complaints of these things were frequently made in high quarters. Dead uieu were in the morning fre quently found among the living, 'i'lio lar gest number of dcathB in me Blockade ror ono day, in August, 1864, was -U7. The witness louud Capt. wirli in charge of ths prison when he went there, and left hi m ihero at the time he made his escape. Rations were cut off from tho euiire number of the :)0,000 prisoners for an entire day, owing to tho alleged ofleuscB of a few others. The witness remembers that Wirls said to him that ho (WirU) would be of more serviae to tbo Confederate Uovern- ment than any of the poor robels in front. Cross-examined by Mr. Baker Was a medical student on the breaking out of tho w ir, and had beeu licensed since. Ho was mustered out on Ihe 7th of Deoember last. The wilnees had never soon our men in the armr wearing a ball and chain, nor had he B.-en them punished in any other way than hv detention in the guard-house He had seen men in our hospitals affected with sy philis, but none ot the oases were so cad as thoBO at Andersonvilie. Our eases were primary, while those there (in the rebel prison) wore secondary, aa a general thing. The orosB-queslioning was further continued to ehow that the rebel hospitals were deficient of medical remedies. The court then, at 1 o'olook, adjourned till 2 o'clock. It is proper to ray tbat Mr. Baker did not voluntarily appear as oounsel lor the defonee, as has been stated, but entered un on Hie duties of oounsel after a consultation with Judgo Hughes, who had just retired from tho oase. Ou the reassembling of Court, the cross-examination of Dr. Barrows was resumed : Lying iu the dirt and owing to insufficient tnedioine aud diet, the ohanoe of recovery was against those who had syphilis. The questions and Answers wore numerous on ihe point involving the treatment of dla eases. - Assistant Judgo Advooate Hosmer here nai l, he did not seo the relevancy of these ouestionB. The only r prisoners more at the time, were mose wno naa oeen brought from Belle Isle, Libby Prison and o her points. They were ragged and destitute of olothing. Many were nearly naked, and totally unprovided with shelter, except tattered blankets. Men were more skeletons. The prison appeared to do crowded, inougn thousands were brought there afterwards. The men were in a filthy condition. There was a poor or. portunity to keep clean; was very little soap. The men would get smoked over the pine fire, and for want of soap oould not remoTS tbo stain tnis smoke made. If any ono orossed from the prison to the swamp he would be shot at. Onoe he stepped to the brook to waBh his hands, when a sontiuel fired at him, but missed his object, and he soon got out of the reaoh of danger, Mr. Bakor objected to a question asked by tho Judge Advocate, saying somebody was nurt, not Killed, and therefore somebody must be bung. The Court rebuked the consel, Baying that sucn remarks were excessively improper, and there was a remedy to prevent their repetition. The objeotion of oounsel was not sustained by ihe Court. The witness said he did not remember whether the man shot for drawing water out of the brook was killed that day or not. Quantily as wollas quality of rations was irregular. Some days they got nothing at all, and some days a short allowanoe, and others there was a full quantity such as it was. Thirly-two out of the squad of ninety men to whioh he was attached, were unable to Btand when ordered to form in line by the sergeant. Their inability to do so arose principally from sourvy and diarrhoea Their limbs were oontracted, and therefore they could not keep their feet. Baker- "It is a notorious faot, of whioh tho world has takon oognisanoe." The J uuge Advocate "Uonth en tlio olaoi Mu.r"ra eeie bii.u, yci, that onse the counsel tor defense made objeotion to Boolh's name in the oharges." Mr. Mr. uaaer replied mat a. uau asaeu ine witness with What disease patients suffered, ind. how disease manitested itself after pa tienis were sent to hospital, and whether svulillis was owing io the vaolne matter uacd upon them. He was oross-examining witness on this very point. The Court Vou do not give the witness m opportunity to answer your frequently out Questions. ' Mr. Baker I have a right to thus draw from him any information he has. The Court we are disponed to do very liberal, but you must not supposo at tome time we will not lake exceptions as to the inmner of examining witnesses. ; Mr. Baker"! will nursue the orots-ex. amination in the proper way. The Court "Uo on," The orost-examination was further continued, when the oourt interrupted counsel by saying! . : . "Hore is another leolure altogether unbecoming and unoalled for." Mr. Baker "I beg tlie court's psrdon." ; The Court "You beg pardon it Is granted."Mr. Baker "I hope you will not hold me to the rule." The oeurt Interrogated the wllneal, who laid the rebel force at Ander- odtiUb wu between 8,000 and 6,000 men. The fuel for them wae out bj a large force of colored men. There were axea enough iu supply our men for a like purpose. The witness gate, as his honest opinion, that if there hod been proper food, olothing, quarters, and other necessary supplies, from 60. ta 80 per cent, of the deaths might hare been prerented". In the dispensary he had 300 pounds, and some bologna sausages. He saw several boxes of clothing at the depot. Never iu his ward saw anvthin. of ih. onn- ' j . . 1 . ololbing. Once or twice a little dried beef was brought in but it did not afford each man in the ward half an ounoe. The witness did not know who used ths remainder ot me Deer and sausages. Robert H. Kellogg ..Kworn.-Said he was oopturcd at Plymouth, and with about 400 otnsr prisoners, was taken to Andersonvilie. This was the 3d of May, 1804. The nights wero cool, when he first went there. but as the season advanced the weather be came intensely hot. There were 21 rainy uhvs in tue nionin oi june. 'Che nrisonfrs were uot suupim ly or sunioiently with fuel. Sometimes a squad would be allowed to go out Io bring in fine roots to make a fire. Sometimes Ihe rations furnished were raw, with no wood to cook. The penalty of trespassing on Ihe aead-iine was deatn. lie remembered see- im; a man who was shot for this cause, bv sentinels. The broox running through the prison was exceedingly filthy. Tho surface of it was covered with grease. Wo often went into It bare footed. Nearly three hundred out of the four hundred who accompanied him to Au- dorsonville, died in a few days after they wero paroled, ino znnaew lorn battery, captured at Plymouth, were noarly annihi. laiou at tnis prison.
